1 General
1.1 "Unibet" or "Betchoice" are references to Betchoice Corporation Pty Ltd A.C.N 71 121 382 607, trading as Unibet, a company registered in Australia under the Corporations Act 2001. Unibet is licensed by the Northern Territory Racing and Wagering Commission to accept wagers by telephone and the internet.
1.2 To open a betting account with Unibet (Account or Betting Account) you must be aged 18 years or older. You must not open an Account with Unibet if you are under 18 years old. A 'Client' is a person who holds an Account, and any reference to 'you'/‘You’, or 'your'/’Your’ or 'Account Holder' in these terms and conditions is a reference to a Client. If the Client is less than 18 years of age, Unibet reserves the right to (a) close the Client’s Account and/or (b) refuse or void any wager or part of a wager or withhold deposited funds without giving a reason at any time.
1.3 This set of terms and conditions ('Terms') as well as the Privacy Policy, and the Unibet Rules of Racing and Sport ('Rules') govern the use of the Unibet website (www.unibet.com.au, Unibet App and any pages or websites under the Unibet brand and any Unibet applications that are owned and operated by Unibet (the 'Website') and telephone service (collectively the 'Service').
1.4 By using the Service, as a Client or guest, the Client or guest is therefore agreeing that s/he has read, understood and will comply with these Terms, Rules, Privacy Policy and any other Unibet policy published on the Website.
1.5 Access to Unibet's Website/s is provided on a temporary basis, at the sole discretion of Unibet. Unibet reserves the right to withdraw, restrict access or amend the service it provides on its Website without notice. You agree that:
a. Online or telephone betting may be illegal or restricted in the country in which you are located or reside and if so, you are not authorised to open an Account with Unibet, use or attempt to use the services Unibet provides on its Websites or use a payment card or payment method to complete transaction(s) or place a bet on the Websites. You further agree that it is your responsibility to understand, know and comply with the applicable laws and regulations concerning online and telephone betting in the country in which you are located or reside prior to either applying to become a Client or placing a bet on your Unibet Account.
b. We monitor transactions on your Account periodically and you accept that if we detect any activity that indicates that you are or may be betting on your Account in a country where online or telephone betting is illegal, we may at our sole discretion, suspend or permanently close your Account, refuse or cancel any bets and/or not permit withdrawal of the original funds until Client has satisfied our request for proof of method, personal identification and ban Account information.
1.6 Unibet shall make a recording of all telephone calls that take place between Unibet and Clients, both incoming and outgoing. The Client consents to these recordings being made and the Client agrees that the relevant recording(s) and/or any records of a Client's transactions may be made available to any Authority (as defined in Cl 8 of 'Unibet's Reserved Rights'). All records of voice recordings will be securely retained by us in accordance with our privacy obligations and for regulatory purposes.
1.7 All dividends shown are for a $1 investment. All tote-based dividends displayed are approximate only.
1.8 If any provision in these Terms or the Rules is or becomes void or unenforceable, that provision will be taken to be removed and cease to form part of the Terms or the Rules. However, the remaining Terms or Rules will continue to have full force and effect.
1.9 Upon acceptance of these Terms by the Client, the Terms (as amended from time to time under paragraph 7 above) are irrevocable and will remain in effect for as long as the Client holds a Betting Account.
1.10 None of Unibet's agents or representatives are authorised to make any representations, statements, conditions or agreements and Unibet is not bound by any such unauthorised statements.
1.11 The Client undertakes to update their Unibet account details within three (3) days of any change in the Client's name and/or any other change in the Client's details (including but not limited to changes in the Client's residential address, email address, or telephone number). Unibet, at its discretion, may require formal proof of these changes in line with Clause 3.
1.12 Once a Betting Account has been opened, it cannot be used (that is bets cannot be placed) until the Client has elected whether s/he wishes to set a deposit pre-commitment level. If the Client elects to set a pre-commitment level (PCL), the Betting Account cannot be used until the Client has set a PCL. If a client sets a PCL, that Client agrees that:
a. the amount s/he deposits into their Betting Account in each defined PCL period will not exceed the amount of the PCL;
b. if s/he chooses to lower their PCL, the new limit will be in force immediately; and
c. if s/he chooses to increase their PCL or revoke their PCL (i.e. so that they elect NOT to set a PCL), the increased or revoked limit will not take effect until seven (7) days after the request.
1.13 Unibet is licensed and regulated by the Northern Territory Racing and Wagering Commission (the NTRWC) and all wagers are considered to be placed and received in the Northern Territory in the Commonwealth of Australia.
1.14 These Terms will be construed in accordance with the laws of the Northern Territory. You agree, subject to Clause 1.13, that you irrevocably submit to the exclusive jurisdiction of the courts of the Northern Territory in respect of any dispute arising out of these Terms or Unibet's provision of the Service.
1.15 Any complaints you may have about your use of the Service or any dispute between you and Unibet, subject to clause 18 below, will be dealt with in the following manner:
a. In the first instance, you should email your complaint to customerservice@unibet.com.au
You are required to attempt to resolve your complaint directly with Unibet through Customer Support. We hold an extensive resource of audit logs, transaction history, and call recordings where a simple call/email/chat might promptly resolve your issue.
b. If you're not able to resolve your dispute directly with Unibet, this may then be escalated to the Northern Territory Racing and Wagering Commission (NTRWC) as a dispute.
NB The NTRWC will not settle disputes relating to the following:
- requests for compensation or damages
- customer service disputes
- complaints about bets that were never accepted, processed, or refused
- including cashouts being removed or not being offered
- betting accounts where restrictions have been imposed by the wagering operator
- including the use of their promotions, or on the amount a customer can bet
- complaints about minimum bet laws
- betting accounts that have been closed by the wagering operator.
If your complaint relates to any of the above, you should seek legal advice to check your options.

The NTRWC's decision shall be binding and may be entered as a judgment in any court of competent jurisdiction.
Note that Unibet may also lodge a dispute with the NTRWC about Client behavior that breaches these Terms.
1.16 Unibet shall not be liable for any default due to any act of God, war, terrorism, strike, lock out, industrial action, fire, flood, drought, storm, power surge, or other event beyond its reasonable control.
1.17 Irrespective of anything else in these Terms, any dispute under the "Default" section of these Terms will be dealt with in accordance with the procedures set out in that section.
1.18 We recommend that you may wish to retain a record of transactions made by you on the Websites, these Terms, Privacy Policy and the Rules.
1.19 In accordance with its NTRWC Licence Conditions, Unibet maintains a separate bank account which contains sufficient funds to match every dollar of Client’s funds. This requirement is regularly monitored by the NTRWC to ensure compliance.
2 Restrictions on use of Unibet Websites
In accessing or using Unibet Websites you agree that you will not:
2.1 Use any automated device, software, process or means to access, retrieve, scrape, or index Unibet Websites or any content on Unibet Websites without Unibet’s express prior written consent.
2.2 Use any device, software, process or means to interfere or attempt to interfere with the proper working of Unibet Websites.
2.3 Undertake any action that will impose a burden or make excessive traffic demands on Unibet’s infrastructure that it deems, in its sole discretion to be unreasonable or disproportionate site usage;
2.4 Use or index any content or data on Unibet Websites for purposes of competing with Unibet in any manner that Unibet has not specifically authorised.
2.5 Transmit spam, chain letters, contests, junk email, surveys, or other mass messaging, whether commercial in nature or not.
2.6 Use Unibet Websites or any content from Unibet Websites in any manner which is, in Unibet’s sole discretion, not reasonable and / or not for the purpose it is made available.
2.7 Violate the rights of any person, including copyright, trade secret, privacy right or any other intellectual property or proprietary right.
2.8 Pose as any person or entity or attempt to solicit money, passwords or personal information from any person.
2.9 Act in violation of any Term or condition of use of Unibet Websites including Unibet's General Rules, Sports Rules, or Racing Rules, or any other terms and conditions posed by Unibet or any applicable law.
2.10 Reproduce, republish, retransmit, modify, adapt, distribute, translate, create derivative works or adaptations of, publicly display, sell, trade, or in any way exploit Unibet Websites or any content on Unibet Websites, except as expressly authorised by Unibet; or
2.11 Transmit or attempt to transmit any computer viruses, worms, defects, Trojan horses or other items of a destructive or invasive nature.
Unibet reserves the right to exercise whatever means it deems necessary to prevent unauthorised access to or use of Unibet Websites, including, but not limited to, instituting technological barriers, or reporting your conduct to any person or entity.
3 Intellectual Property
Unless indicated otherwise, all intellectual property in Unibet Websites is owned or licensed by Unibet. Subject to these Terms, You agree that You will not infringe Unibet intellectual property as contained in Unibet Websites and will not modify, copy, republish, frame, distribute or communicate any part of Unibet r Websites or any information contained in it or otherwise use Unibet Websites in a way which will infringe Unibet intellectual property or other rights.
4 Use of Information
You agree that content You provide to Unibet in the course of accessing or using Unibet Websites, will be available to Unibet to use in any manner Unibet thinks fit subject to applicable provisions of any legislation including, without limitation, privacy legislation.
You agree, and continuously represent and warrant each time You access Your Account and Unibet Websites that You will not upload or otherwise provide any content which:
4.1 Is inaccurate, misleading, deceptive, incomplete, defamatory, fraudulent, unlawful, tortious or confidential;
4.2 Infringes the intellectual or other proprietary interests of third parties.
4.3 Contains spam, computer viruses, computer code, files or programs or other harmful components that are designed to interrupt, destroy, change or limit the functionality of Unibet Websites or any other computer software, hardware or other electronic equipment, information which in any way impinges on another user's use or enjoyment of Unibet Websites or otherwise breaches or encourages other users to breach these Terms.
4.4 Violates any law, statute or regulation; and/or
4.5 Forges information to disguise the origin of any Content.
5 Third Party Content
Unibet Websites contain content provided to Unibet by other parties (Third Party Content). This includes the information relating to sports and betting. Unibet is not responsible for, do not endorse and make no representations either expressly or impliedly concerning Third Party Content. Third Party Content does not represent Unibet views. You rely on Third Party Content completely at Your own risk.
6 Client Responsibility
6.1 Clients are responsible for ensuring that their records, especially address, telephone number, email address and payment/bank details (including any applicable card expiration details) are kept up to date. In the event that a Client has not kept their records up to date, Unibet reserves the right to suspend the Client's Betting Account.
6.2 It is the Client's responsibility to ensure that they keep their user-name and security details confidential. In the event that a Client suspects that this may no longer be the case, they should notify Unibet immediately whereupon new details may be given. Upon notification of the new details, Unibet reserves the right to invalidate any future transactions utilising the previous details.
You must not disclose your password to anyone or allow any other person to access or use your Account. You agree to check the balance of your Account each time you log on to your Account or at the time you place a bet. In the event of a query, it is the Client’s responsibility to notify Unibet immediately.
6.3 Clients will be responsible for any and all activity on their Betting Account, including any Bets placed while their Betting Account was accessed by any third party whether authorised or unauthorised. Unibet management, in its absolute discretion, will determine if these bets should stand.
6.4 Unibet does not warrant or imply that the Service complies with the legal requirements of any state or country other than the Northern Territory. Clients must satisfy themselves (and assume full responsibility) of the legality of their actions under any applicable law in connection with the following (without limitation):
a. using the Service (including accessing the Website);
b. applying to Unibet for a Betting Account;
c. remitting funds by an applicable card or other means to a Client Betting Account held with Unibet;
d. placement of wagers with Unibet; and
e. receiving payments from Unibet.
6.5 Unibet’s Websites contain adult content and is intended for use by persons over the age of 18.
6.6 If you receive activity statements, we'll send an email to your nominated email address (Notification) advising that you have a new activity statement available or attach the activity statement in the Notification (as applicable). It's your responsibility to check your email for these Notifications and access the attachments promptly following our email. You must also keep your nominated email address current and let us know if you can't access your email for any reason. You can change your nominated email address at any time by logging-in to your Account. You will not receive a monthly activity statement if you are not an active Account holder or if you have not used your Account in more than 12 months.
6.7 Where a Client has been referred to Unibet by a third party including by a third party operated website and where that third party is an affiliate or agent of Unibet, you acknowledge that Unibet may make commission payments to that third party. Payments to agents or affiliates are unrelated to the odds or prize money offered to the Client by Unibet.
6.8 You agree that any reference to discretion or determination which may be exercised by Unibet under these Terms means Unibet’s sole and absolute discretion.
7 Client Identification Requirements
7.1 The Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth) (the Act), National Consumer Protection Framework (NCPF) and NT regulations require Unibet to verify the identity of each Client. As at 29 September 2023, Clients are required to verify their identity prior to the opening of an Account. You cannot transact on an Account until your identity is verified. The procedure for identification is set out on our Website.
7.2 By accepting these terms and conditions you give consent for Unibet to disclose your name, residential address and date of birth to a third party provider (e.g. Green Id, Dun and Bradstreet, Edentiti ) for the purpose of electronic identification verification, which may involve checking the Client’s ID against third party databases, including credit reporting agencies.
The credit reporting agency may prepare and provide Unibet with an assessment of personal identification against credit records and may use your personal information including the names, residential addresses and dates of birth contained in credit information files of you and other individuals for the purposes of preparing such an assessment. Unibet may also use other public information to verify a Client’s identity.

7.3 Unibet requires proof of a Client’s current address. If the Client’s address is not verified by third party or provided via a legible copy of the front or back of an acceptable piece of photographic identification (eg license, passport), the Client must provide proof of current address acceptable to Unibet. Acceptable proof of current address in such circumstances may include, at Unibet’s discretion, a certified copy of one or more of the following documents (which must be dated no more than 3 months prior to the date that the Client provides the document to Unibet):
a) a rates notice;
b) a utility bill; or
c) a statement from a financial institution; or
d) an official Australian governmental letter.
7.4 All certified documents must be produced in the English language or they will be rejected. Unibet reserves the right to carry out checks on the individual certifying documents and to contact the issuing entity and / or certifier to verify the validity of the document. Unibet may in its discretion reject certified documents for any reason.
7.5 Unibet may at any time request acceptable photographic identification and proof of a Client’s current address from a Client to ensure that all information supplied by the Client is up to date. This may require official certification of a Client’s ID documents by a permitted Certifier upon our request.
7.6 Should a Client deliberately falsify any Identification or any other details for any purpose associated with applying for an Account or transacting on the Account, Unibet reserves the right to suspend the Account and/or close the Account without prior notification to the Client.
7.7 If a Prepaid/Virtual/Electronic/Travel/Debit Card is to be used by a Client to fund the Account, legible copies of the front of the applicable card may be requested by Unibet for its approval. Unibet reserves the right at its discretion to refuse to accept a card including but not limited to in circumstances where the card is dishonoured. Cards used to fund a Client's Account must match the Client's Account details.
Cards with a name other than that which is registered with Unibet for the Account in question may be refused and the Account may be suspended until proof of consent is provided by the third party cardholder. Unibet reserves the right to request a copy of the front of the card registered on the Account at any time. Receipt of a card is no guarantee of Account activation/re-activation. In the event that Unibet detects a third party deposit after there is betting activity on the Account, Unibet may at its sole discretion void any settled and/or outstanding bets, and refund the initial deposit.
7.8 Under the terms of our licence, Unibet must be reasonably satisfied that all Clients are 18 years of age or older. If a Client's identification is not received by Unibet or age verification is not established to Unibet’s satisfaction upon the opening of the Client's registration then the Betting Account will not be opened or be suspended until identification is received. No bets shall be made until the Client’s identification is completed.
7.9 If Unibet determines that funds deposited are not for the purpose of betting, Unibet may in its discretion decline the deposit, return the funds to the bank account used to fund the Account, and close the Client's Account.
7.10 If Unibet determines that the funds deposited are not from a funding instrument in the Client’s name or are not expressly authorised to be used by them, Unibet reserves the right to decline the deposit and return the funds to the original payment method. If this determination takes place after bets have been placed, Unibet reserves the right to void any resulted or pending bets on the Client’s Account.
7.11 If Unibet determines that there is not enough information to prove the owner of a particular payment option, we reserve the right to request certified documentation as proof of ownership prior to making any decision.
7.12 Unibet reserves the right to check directly with the Client’s funding institution that supplied the payment option used to deposit to confirm that the details provided by the Client to Unibet are valid and correct.
7.13 Unibet requires that any deposits into a Client's Account be turned over at least once or 'bet through' prior to authorising a withdrawal from the Client's Account.
7.14 Unibet reserves the right to waive clause 7.13 should the Client be restricted in stake while placing a bet, if an error is made during a transaction, or for any other reason, determined at our discretion.
7.15 Unibet must comply with the Act. Should we consider that a deposit or withdrawal may potentially be fraudulent, we reserve the right to request proof of deposit or withdrawal bank account information to verify that the information provided is true and correct prior to permitting funds to be withdrawn from the Account.
7.16 Client agree that as the account holder, you are the only person permitted to use your Account (including accessing, betting with, depositing funds into, and withdrawing funds from your Account). Third party bank account holders or applicable card holders must not transact on an Account that has not been registered in their name.
7.17 Unibet reserves the right to prevent funds being withdrawn from a Client Betting Account and place limits on deposits until the Client has completed the identification, financial verification and age verification processes satisfactorily. Funds will be processed and paid as soon as this process has been completed to the satisfaction of Unibet in its sole discretion.
8 Unibet's Reserved Rights
8.1 The Client acknowledges that:
a. Unibet has the right under these Terms to refuse a wager (i.e. before it has been accepted), and/or
b. it also has the right to void a wager (i.e. after it has been accepted). The Client agrees that the Reserved Rights as defined in this section of the Terms are in addition to Unibet’s rights in the Cancellation (Voiding) of Bets in clause 14 of these Terms.
8.2 Unibet reserves the right at any time to refuse or cancel any wager and/or void a wager or winnings, or refuse or void any part of a wager (the Reserved Rights), without giving a reason at any time if any one or more of the following occur or in Unibet’s reasonable opinion that:
b. the Client is betting on behalf of a person who is less than 18 years of age;
c. the Client is in breach of these Terms and/or Rules;
d. there is possible fraudulent or inappropriate activity in relation to a Betting Account, including but not limited to reasonable concerns in respect of any possible fraud, collusion, unlawful or improper activity.
h. the Client is acting on behalf of another party;
i. the Client is conducting criminal or illegal activities whereby an Account is directly or indirectly involved;
j. the Client is employing or making use of a system (including machines, robots, computers, software or any other automated system) designed to defeat or capable of defeating or circumventing the Unibet’s Application and/or Software;
k. the Client is using the Services illegally in his/her country of residence or otherwise restricted for him/her to open a gaming account, purchase or use services from Unibet and/or otherwise participate in the games offered. It is the Account Holder’s responsibility to ensure his/her use of Unibet’s Website and Services is legal;
l. the Client knowingly exploits, or intentionally seeks, to exploit a market or a Term or Rules (including by deception);
m. the Client seeks to manipulate the outcome of a market (whether or not for personal gain);
n. the Client receives un unjust advantage from information, which is not known to the public;
o. the Client intentionally abuses an inadvertent error in the description of a market or pricing (whether before or after Unibet corrects the relevant descriptor or pricing);
p. the Client intentionally abuses an inadvertent software or technical error and places a bet after the market is closed and an outcome has been reached;
q. the Client opens an Account in circumstances where Unibet reasonably suspects the person has previously or is currently self-excluded, the Account is being operated (whether directly or indirectly) by a third party who has previously or is currently self-excluded.
8.3 In addition, if any of the matters set out in clause 8.2 applies and/or failures to comply with clause 17 applies, at Unibet’s sole discretion and without further explanation, Unibet reserves the right to, without further explanation to:
a. suspend or permanently close a Client's Betting Account and refund the balance of the Betting Account; or
b. suspend or permanently close a Client’s Betting Account and refund deposits of any cancelled or voided wagers; or
c. suspend or permanently close a Client’s Betting Account and withhold deposited funds or balance of the Betting Account;
In this event, any outstanding wagers that are not voided or cancelled, will be honoured unless Unibet management declares otherwise at its sole discretion.
8.4 Unibet reserves the right to close a Client's Betting Account and refund the balance of the Betting Account without further explanation. In this event, any outstanding wagers, after the application of Cl 4.2, will be honored unless Unibet management declares otherwise.
8.5 Unibet reserves the right to withhold the deposited funds and/or withhold payment and (subject to the concurrence of the NTRWC) to declare bets on an event void if we have evidence that any of the following has occurred:
a. the integrity of the event has been called into question;
b. the price(s) or pool has been manipulated; or
c. match rigging has taken place.
Evidence of the above may be based on the size, volume or pattern of bets placed with Unibet or other factors of which Unibet is aware. A decision given by the relevant governing body of the sport in question (if any) will be conclusive.
8.6 Unibet has the right to provide Australian sporting bodies, upon their request, with:
a. records, documents or other information in the possession or control of Unibet relating to betting transactions of any Client; and
b. the name(s), contact details and similar identifying information in the possession or control of Unibet relating to any Client
Such information will only be provided as required by contract or to assist in a legitimate inquiry conducted by any Authority (as defined below) . For the avoidance of doubt, the Client consents to Unibet providing the above information to an Authority. ’Authority’ includes any Australian Governing Sports Body (as defined below), Australian law enforcement agency and the Northern Territory Racing and Wagering Commission and BetStop – the National Self-Exclusion Register. Only the information in clause 8.5(b) shall be provided to BetStop – the National Self-Exclusion Register in accordance with the Interactive Gambling (National Self-exclusion Register) Register Rules 2022 (Cth).
"Australian Governing Sporting Body" means any organisation charged with the administration of thoroughbred horse racing, harness racing and greyhound racing throughout Australia as well as organisations charged with the administration of particular sports in Australia including but not limited to Tennis Australia, Cricket Australia, the Australian Football League, Australian Rugby Union, Netball Australia, Football Federation Australia, Professional Golf Association of Australia and the National Rugby League.
8.7 Irrespective of anything contained elsewhere in these Terms or the Rules, if Unibet publishes, posts or quotes any incorrect betting information for any sporting event, such as posting wrong dividends or lines, then regardless of the cause or source of such error;
a. where the error is identified prior to the commencement of the event and notified by Unibet to the most recent telephone or facsimile contact number or email address supplied by a Client and this notification takes places after that Client’s wager on that event has been accepted or confirmed by Unibet, such wagers will be void. If the wager is part of a multi bet, the wager will then be re-calculated without the team/competitor to which the error related.
b. where the error is identified only after the commencement of the event or for any other reason not notified to the Client's point of contact prior to commencement of the event, the wager on the event shall stand. The only exception is where Unibet can demonstrate that the error was manifest or obvious, or that the Client otherwise should reasonably have been aware of the error when the wager was placed.
8.8 Unibet has made considerable efforts to ensure its Service operates in a fair, prompt and accurate manner. Save to the extent permitted by Australian law (and only to such an extent), Unibet excludes all warranties (express or implied) relating to its wagering business and shall not have any liability for direct, indirect or consequential loss, damage, expense or injury suffered by any Client.
Subject to the Rule/s which apply to that wager and Australian law, Unibet's liability in respect of any claim or loss, including a contractual claim under these Terms, shall be limited in amount to the amount of the relevant wager placed by a Client.
8.9 Client may only have one (1) Betting Account unless otherwise agreed to by Unibet. If a Client has more than one (1) Betting Account(s), Unibet may transfer the Account balances of the additional Client Betting Account(s) into the original Client Betting Account and, if, after the transfers from the additional Client Betting Account(s):
a. the original Betting Account has a debit balance, the Client shall, upon Unibet's demand, make payment for the debit balance immediately; or
b. the original Betting Account has a credit balance, this balance may be held by Unibet until such time as a determination has been made by Unibet as to whether or not there has been a breach of these Terms.
8.10 Subject to the terms and conditions of a specific promotion or offer, where a Client is offered a bonus by Unibet and the Client is required to make a deposit to claim the bonus, the Client must wager the value of their qualifying deposit before the Client is entitled to withdraw any winnings related to the bonus. Unibet reserves the right to revoke the bonus and refund the remaining balance should a Client be in breach of this Term or the terms and conditions of the specific bonus.
8.11 If a Client wishes to withdraw funds they have deposited into their Unibet Account before having wagered the funds in any event/betting offer, Unibet reserves the right to refuse the Client to withdraw the deposited funds until such time as the entirety of the funds has first been wagered.
8.12 Unibet reserves the right, in its sole discretion, to determine that a Client is not eligible for certain products, bet types, or promotions.
8.13 Unibet reserve the rights to remove or add payment options from time to time.
9 Acceptance
9.1 Wagers will be accepted up to the advertised start time of the event or such time as determined by Unibet.
9.2 If a wager is inadvertently accepted in respect of an event after it starts, Unibet shall have the discretion to void the wager and refund the stake to the Client’s Betting Account. When making a wager via the telephone, it is the Client's responsibility to quote their correct user-name and/or User Number.
9.3 Unibet has the right to refuse any wager placed via the telephone where the amount staked is less than AUD$10.
9.4 The minimum stake of any wager placed via the Website is AUD$1.00.
9.5 All prices/lines are subject to variation and, with the exception of tote-related or top fluctuation wagers, will only be fixed once the wager is accepted by Unibet.
9.6 Each-way wagers placed via the Website must be the same stake for the win and place portion unless placed as separate win and place transactions.
9.7 Unibet may, in its absolute discretion, offer the 'Cash Out feature' for selected products or bet types. The Cash Out feature, and any bets in respect of which the Cash Out feature is available, are governed by these Rules and the additional rules described here ('Cash Out Rules'). In the event of any inconsistency between these Rules and the Cash Out Rules, the Cash Out Rules will prevail to the extent of the inconsistency. By entering into a bet, you acknowledge that:
a. you may not be able to Cash Out your bet at any particular time, or at all, during a bet; and
b. Unibet may deny your request to Cash Out your bet for any reason whatsoever.
9.8 Unless accepted in error, once accepted, a bet will remain valid and cannot be withdrawn or changed. It is the responsibility of the Client, at the time they place the bet, to ensure details of the bet placed are correctly. The Client further agrees and acknowledges that any bets placed are subject to Unibet’s Reserved Rights in clause 8 and any other reserved rights set out in these Terms including but not limited to clauses 1.2, 2, 7, 11, 13, 14, 15 and 17.
9.9 The Client agrees that should a dispute arise about the acceptance (or lack thereof) of any transaction in the Client's Betting Account, the log of transactions displayed in the 'Transactions' section of the Website will be the ultimate authority in deciding such matters (subject to any subsequent determination reached by the NTRWC).
10 Payment Terms
10.1 At any given time, the balance of a Client's Betting Account will be either a debit balance, credit balance or nil ('Account Balance'). At any given point in time, the Account Balance is the difference between:
a. the sum of the unsettled wagers (that is, the wagers listed as 'Open' in the 'Transaction' section once the Client is logged in to the Website) made by the Client; and
b. the sum of any deposits made by the Client and winnings payable by Unibet for all settlement periods.
If the sum of the unsettled wagers exceed the sum of Client deposits and winnings, the Account Balance is a debit balance. If the sum of Client deposits and winnings exceeds the sum of the unsettled wagers, the Account Balance is a credit balance. If the sum of the unsettled wagers and the sum of the Client deposits and winnings are equal, the Account Balance is nil.
10.2 Subject to the remainder of this ’Payment’ section of these Terms, a Client cannot place a bet unless the ’Account Balance’ is a credit balance.
10.3 To ensure that their Account Balance is a credit balance and/or to make a payment to Unibet of funds owed by the Client to Unibet, a Client must deposit funds into their Betting Account by cheque, bank cheque, applicable card, direct credit, PayPal, BPay, ApplePay, PayID or by any other method as agreed to between the Client and Unibet.
10.4 Each bet will be settled and, if applicable, winnings will be credited to a Client's Betting Account following confirmation of the final result. If any winnings are credited to a Client's Betting Account in error, the Client must notify Unibet immediately. Any funds credited to the Client in error by Unibet are immediately due and payable to Unibet. If necessary, Unibet will issue the Client with a Notification (as defined below) in respect of the return of these funds.
10.5 Clients should check their Account Balance each time they log on to the Website or at the time they place their wager via the telephone. If a Client reasonably believes that there is an error or inconsistency in the Account Balance, it is the Client's responsibility to notify Unibet at the earliest opportunity of this and to provide Unibet with any information reasonably required by Unibet (including the Client's own record of transactions) to enable Unibet to investigate.
10.6 In relation to a Client's Betting Account;
a. if the Client's Betting Account has a credit balance, that Client may, at any time, withdraw part or all of their Account Balance using the Website or by telephone; and
b. the Client acknowledges that their Betting Account may have a debit balance as a result of the normal operation of their Betting Account. If their Betting Account has a debit balance, it is the Client's responsibility to immediately repay Unibet the debit balance without demand from Unibet.
c. Unibet will refuse to accept that Client's wagers if their Account Balance, at any time, is a debit balance or if the effect of any wager would cause their Account Balance to become a debit balance
10.7 For the avoidance of doubt, it is the Client's responsibility to monitor the balance of his/her Client Betting Account and, if, for whatever reason, their Account Balance is a debit balance, it is the Client's responsibility to ensure that the debit balance is settled in accordance with these Terms.
11 Betting and Payout Limitations
11.1 The amount that a Client may stake is subject to pre-imposed limits set out in these terms and the Sports and Racing Rules. However, Unibet reserves the right to vary these limits, including generally or in respect of any Clients or Client, at its sole discretion. The Client may seek permission to exceed the applicable limit by means of a request effected through the Website or the telephone service. Unibet reserves the right to accept (fully or partially) or reject the said request without any prior notice and further explanation. Unibet is required to provide Minimum Bet Limits (MBL) or similar for certain betting contingencies.
11.2 Unibet reserves the right to withhold your deposited funds of any account and withhold any payment of winnings where it relates to an event which is the subject of an investigation being conducted by a racing or sporting body, where any of the Terms are breached, including but not limited to Cl 4.4 or ID and / or financial verification requirements have not been met to the satisfaction of Unibet.
11.3 Due to local regulations not all sports may be available in your (the Client's) state or territory.
12 Bet Share Rules
12.1 Bet Share is a tool offered by Unibet that allows the Account Holder to personalise and share their betslip via social media. The rules applicable to the use of Bet Share consist of the general terms and conditions of Unibet and, additionally, these Bet Share rules.
12.2 The Bet Share Rules are an integral part of the Contract between Unibet and an Account Holder. By accepting the Unibet Rules, the Account Holder confirms that he has read and understood the Bet Share Rules, in particular that he has read and understood the warranties and indemnities given within the Bet Share Rules at sections 1.2 and 3, and that he will abide by them.
13 Default
Default
13.1 If the Client defaults in payment of any Settlement when due under Cl 6, the Client shall indemnify Unibet from and against all Unibet's costs and disbursements including in respect of any legal fees spent by Unibet to recover the debt and all of the Unibet's costs of collection, which may include any commission of fees paid or payable to any third party commercial or mercantile agent.
13.2 If any Settlement remains unpaid at the end of the second month after the most recent of the relevant wagers was made a fee may be charged to the Account immediately.
13.3 If the Client defaults in payment of any Settlement when due, the Client agrees that Unibet reserves the right to initiate proceedings in respect of the recovery of these debts through the Courts of the Northern Territory, or any other Court in addition to the other rights set out in this section of the Terms.
Charge backs
13.4 Clients agree and warrant that no charge-backs or other cancellation of deposits will be made relating to your Account without Unibet's consent. In the event of any of the foregoing occurring, you agree to indemnify us for any costs, claims, damages and expenses relating to or arising in connection with this, including any expense incurred by us in recovering such amounts.
13.5 If a Client disputes a financial transaction on their Account relating to a third party (e.g. Bank, eWallet), Unibet may temporarily suspend your Account, without notice, pending an investigation by us relating to the transaction. If we incur any loss as a result of that investigation, Unibet reserves its right to recover such losses from you.
13.6 If you use any of Unibet banking specific options (BPay/EFT/PayPal/ApplePay or Cheque) you accept that Unibet may request a certified or non-certified bank statement to verify where funds have originated from prior to any withdrawal being approved. You also accept that Unibet may continue to suspend or permanently close your account after the investigation, decide to return these funds at its discretion and/or void bets should it deem the funds may be unauthorised or there was no lawful ownership of the originating funds.
Fraud
13.7 Unibet reserves the right to withhold deposited funds and/or winnings from resulted bets and/or suspend or permanently close the Client’s Account should Unibet in its sole discretion determine that:
a. an Account is closed or suspended due to or in connection with the matters set out in:
i. clause 8.2 (d), (e), (g), (h), (i), (j), (l), (m), (n), (o), (p) and (q); or
ii. clause 17;
iii. a Client deliberately falsify any ID or any other details for any purpose associated with apply for an Account or transacting on the Account.
b. an applicable card has been misused or used fraudulently. Any matters of inappropriate or fraudulent use of any applicable card will be reported to the relevant authority.
13.8 Unibet may employ third party technologies to track and store technical information on the device that Clients use to process transactions. Clients accept that this data may be used to reach decisions on investigations where Accounts have not been operated in good faith, including but not limited to Account takeover, bonus or betting abuse, multiple Account operations, payment method abuse etc.
13.9 Unibet reserves the right to close the Accounts of, withhold the deposited funds of a Client’s account and void any or all bets made by any person, group of people or corporation in an attempt to defraud Unibet.
13.10 Unibet may periodically review Accounts to monitor any activity that it might consider unusual. In this instance, Unibet reserves the right to suspend an Account pending a full investigation, without notice.
14 Cancellation (Voiding) of Bets
14.1 In respect of bets placed before the start of an event, bets may be voided where:
a. Betting occurs after a related event was underway and where conditions could have been altered in a direct and indisputable way.
b. Bets are placed where an obvious mistake has been made by Unibet.
14.2 In respect of bets placed after the start of a sports event (note: online livebetting is illegal and not permitted via the Website on sports events), bets may be voided in the event that:
a. Betting occurs at an incorrect price due to delayed or failing "Live” coverage;
b. Betting occurs on particular offers after these have occurred or else after an event which could normally be deemed as leading to the outcome (E.g. bets placed on offers such as Total Goals Scored or Next Goal while a penalty is being taken, or has been awarded);
c. Bets are placed where an obvious mistake has been made by Unibet.
14.3 If identification or AML requirements have not been met as required by these Terms in respect of any Client, all bets may be voided in respect of that Client, any winnings relating to the bet will be declared null and void and/or Unibet may at its discretion withhold the Client’s deposited funds.
15 Promotions
15.1 These terms and conditions relate to any Promotions, which Unibet may offer from time to time (collectively, Promotions).
15.2 These terms and conditions are additional to and operate in conjunction with these terms.
15.3 Each Promotion will be subject to specific terms and conditions, which will be published and available to all participants. If these Terms conflict with any terms and conditions relating to a specific Promotion, the specific terms and conditions will prevail to the extent of the inconsistency.
15.4 Unibet reserves the right to modify these terms and conditions, general terms and conditions, and any other terms and conditions relating to Promotions at any time.
15.5 Unibet reserve the right to withdraw any Promotion at any time.
15.6 Unless otherwise stated, each Promotion is valid only once per Client, family, household address, email address, applicable card and/or debit card.
15.7 If a client is entitled to participate in a Promotion, the Client's Account balance must meet any requirements specified in the terms and conditions specific to that Promotion (if applicable), before the client is allowed to:
a. make a bet as part of the Promotion; and
b. withdraw winnings from the bets made as part of the Promotion.
15.8 Subject to the terms and conditions of a specific Promotion, the maximum winnings payable on any Promotion is $50,000.
15.9 Unibet is entitled to, at any time, and in respect of any Client:
15.9.1 accept a bet as part of a Promotion;
15.9.2 cancel a Promotion; and
15.9.3 deduct from a Client's balance winnings from a Promotion,
if that Client is considered by management to be:
a. a licensed bookmaker or a non-recreational gambler;
b. acting on behalf of a licensed bookmaker or non-recreational gambler;
c. opening multiple Accounts under different names;
d. collaborating with another person to open or operate multiple Accounts; or
e. in breach of these terms and conditions, Unibet's general terms and conditions, or any terms and conditions relating to a specific Promotion.
15.10 Promotions are only available to existing eligible Unibet Accounts holders who reside in Australia or New Zealand. Please check the specific terms of each Promotion.
15.11 If identification requirements have not been met as required by these Terms in respect of any Client, all Promotions may be cancelled in respect of that client and any winnings relating to a Promotion will be declared null and void. The Client will have their Account debited in respect of any winnings previously credited to their Account.
15.12 A Client shall only be entitled to participate in one Promotion at any time.
15.13 Unibet reserves the right to cancel, amend, reclaim or refuse bets where any term of the promotion is breached or there is any evidence of a series of bets placed by a customer or group of customers which, due to this promotion, results in guaranteed customer profits.
15.14 Any customers found to be betting on both sides of the same market to qualify for any bonus/ promotion will be disqualified from the promotion/ bonus.
15.15 Unibet reserves the right, in its absolute discretion, to refuse to allow a client to participate in any particular promotional type or promotion. Unibet may provide written notification to certain clients whom Unibet determines to be ineligible to participate in any particular promotional type or group of promotions, with the withdrawal of eligibility taking effect from the date and time of notification.
16 Responsible Gambling
16.1 Unibet:
(a) makes every reasonable effort to prevent self-excluded customers from returning and using our service;
(b) provides pre-commitment facilities to help you control your spend (you can access these via the ‘My Account’ section of our Website); and
(c) provides a self-exclusion facility to help you manage your gambling. At your request, Unibet will prevent you from using your Account indefinitely. Unibet may retain such personal information as is necessary (and for as long as is necessary) to implement the self-exclusion facility as effectively as possible, including the following information: your name, address and payment details. For information on problem gambling generally, please follow the links at the bottom of this and/or other pages of the Website.
16.2 If you are a self-excluded customer:
(a) you must not attempt to open an Account or place any bets with us (using your Account or otherwise);
(b) you are fully liable for your actions, and for all activity and bets placed on your Account; and (c) subject to these Rules, if Unibet considers that you have deliberately circumvented our controls (e.g. by opening a duplicate Account) and placed bets while you are self-excluded:
(i) open/pending bets will be voided and the original stake returned to your Account;
(ii) resulted bets will stand; and
(iii) the balance of your Account will be returned to you.
16.3 Unibet marketing and communications are aimed at over 18's only. Unibet does not market to individuals for whom gambling has become a problem or for Clients who are currently self excluded.
17 Anti-Money Laundering and Counter Terrorism
17.1 Unibet will verify your identity as required by the Anti Money Laundering | Counter Terrorism Financing Act 2006 (AML/CTF Act), and you must comply with any requests made by Unibet regarding this verification, including, without limitation, requests for personal information and/or documents. The AML/CTF Act demands the verification of all clients. Unibet chooses to use Green ID and specialist firms in the industry, who provide a secure online Identification verification procedure that checks sources of data in real time to determine the accuracy of information provided. Failures to comply with the requests made by Unibet regarding verification shall be in accordance with clause 8.3.
17.2 You agree to notify Unibet if you are, or become, a Politically Exposed Person as defined by the AML/CTF Rules The AML/CTF Rules definition of a Politically Exposed Person means "individuals who are or have been entrusted with prominent public functions in a foreign country, for example Heads of State or senior politicians, senior government, judicial or military officials, senior executives of state owned corporations or important political party officials". They can either be categorised as a Domestic or Foreign politically exposed person or as an International Organisation politically exposed person.
18 Disclaimer and Priority
18.1 Unibet reserves the right, at its own discretion, to settle all complaints or other issues on an individual basis on the basis of equity, according to generally accepted betting norms, customs and definitions.
19 Dormant Accounts
19.1 From 1st November 2022, your Account will become dormant if you have not made a deposit or placed a bet on your Account for a period of 12 months or more (Dormant Account). To keep a Dormant Account open, you agree you must pay a yearly fee of $100, which will be deducted partially or in full from the balance of your Dormant Account (unless your Account balance is $0) on or after the 31 October each year after 12 months of dormancy. To avoid this yearly fee, you can either place a bet or withdraw your funds into your bank account and your Account will no longer be deemed as a Dormant Account.
20 Amendments
20.1 Unibet reserves the right to change, amend or add to these Terms, Rules and the Privacy Policy at our discretion, and will publish such changes on our Website. You agree that any changes, amendments or additions published on Unibet's Website will be taken to be effective immediately and you are deemed to have accepted any changes, amendments or additions published on Unibet’s Website if you continue to transact further on your Account or have accepted the updated Terms when you are next logged-in to your Account. If you do not agree with the changes, amendments or additions, you must close your Account with Unibet. It is the Client's responsibility to ensure that they are aware of the current Terms, Rules and Privacy Policy, and Client’s are required to accept any updated Terms prior to being able to transact further on their Account.
